When You Might Need an Evaluation

  • substance use evaluation is often required after a DUI (Driving Under the Influence) or DWI (Driving While Intoxicated) to assess whether the individual has problematic substance use patterns. Courts, probation officers, or the DMV may mandate an evaluation as part of the legal process to determine:

    • The severity of substance use – Is this a one-time incident, or does it indicate a pattern of use that requires intervention?

    • License Reinstatement – Some states require an evaluation before a driver’s license can be reinstated after a suspension.

    • Appropriate next steps – Recommendations for treatment, education programs, or other interventions that can support responsible decision-making.

  • A substance use evaluation is often required by courts or probation officers to assess an individual’s relationship with substances and determine if further intervention is necessary. Some common reasons for this requirement include:

    • Criminal Charges Involving Substance Use– If someone is arrested for possession, public intoxication, or other drug/alcohol-related offenses, the court may require an evaluation to determine the need for treatment.

    • Probation Compliance – Individuals on probation may need to complete an evaluation to demonstrate sobriety or show progress in substance use treatment as part of their conditions.

    • DUI/DWI or Reckless Driving – Those with repeat DUI/DWI offenses or other substance-related traffic violations may need an evaluation to assess whether a treatment program is necessary.

    • Diversion Programs – Courts sometimes offer diversion programs that allow individuals to avoid a conviction by completing an evaluation and any recommended interventions.

    • Domestic Violence or Assault Cases – If substance use played a role in an altercation, a judge may require an evaluation to assess whether alcohol or drugs contributed to the behavior.

    • Child Custody or Family Court Cases – Parents involved in custody disputes may need an evaluation to demonstrate that substance use does not impact their ability to care for a child.

  • substance use evaluation is often required for individuals seeking to participate in a diversion program or expunge their record following a substance-related offense. These programs allow individuals to avoid a conviction or clear their criminal record by completing court-mandated requirements, often including an evaluation and any recommended interventions.

Common Reasons for an Evaluation in Diversion or Expungement Cases:

    • First-Time Drug or Alcohol-Related Offenses– Many jurisdictions offer pretrial diversion programs that allow first-time offenders to avoid prosecution if they complete an evaluation and follow recommendations.

    • Possession or Public Intoxication Charges – Courts may require an evaluation to determine if the incident was isolated or part of a pattern of substance use that requires intervention.

    • Nonviolent Drug-Related Charges – Some states allow for expungement of drug-related offenses if an individual demonstrates rehabilitation, which often includes completing an evaluation.

    • Work & Educational Opportunities – Many individuals seek record expungement to improve their ability to secure employment, housing, or educational opportunities, and courts may require proof of a completed evaluation.

    • Compliance with Treatment or Probation – If an individual has been ordered to complete a treatment program or probation, an evaluation may be necessary to document progress and support expungement eligibility.

  • A substance use evaluation may be necessitated when a student is placed on academic probation as a result of concerns pertaining to drug or alcohol consumption. Institutions of higher education frequently conduct these evaluations to assess the extent to which substance use may be affecting academic performance, behavior on campus, or overall student well-being.

Common Reasons for an Evaluation in Academic Probation Cases:

    • Declining Academic Performance – In instances where a student’s academic grades experience a notable decline, and there is suspicion that substance use may be a contributing factor, the educational institution may mandate a formal evaluation.

    • Violations of Campus Substance Abuse Policies – In the event that a student is found utilizing or possessing controlled substances on campus premises or within student housing, they may be mandated to undergo an evaluation.

    • Incidents of Public Intoxication or Disorderly Conduct – Higher education institutions may require an assessment if a student participates in altercations, disturbances, or engages in reckless behavior while under the influence of alcohol or drugs.

    • Legal Consequences Regarding Enrollment – Should a student face arrest for a DUI, possession, or any other drug-related offense, the educational institution may necessitate an evaluation as a condition for maintaining enrollment.

    • Concerns Expressed by Faculty or Campus Staff – In circumstances where professors, advisors, or resident assistants convey apprehensions regarding a student’s well-being and conduct, the university reserves the right to request a formal evaluation.

  • Not all substance use evaluations are mandated by the court or required by law. Some individuals opt to undergo an evaluation voluntarily to gain insight into their relationship with substances and assess whether they may benefit from support, harm reduction, or treatment.

Common Reasons for Seeking a Voluntary Substance Use Evaluation:

    • Self-Reflection and Personal Development – Certain individuals seek a professional and impartial perspective on their substance use to gain a deeper understanding of patterns, triggers, and potential concerns.

    • Concerns Regarding Dependency or Habitual Use – Should an individual express doubts about the problematic nature of their substance use, an evaluation may assist in assessing risk factors and recommending suitable subsequent actions.

    • Familial or Relational Concerns – Whereby loved ones articulate apprehensions regarding substance use. Consequently, an individual may pursue an evaluation to address these concerns proactively.

    • Health and Well-Being – The use of substances can significantly affect both mental and physical health. Conducting an evaluation may elucidate whether lifestyle modifications or professional assistance could be advantageous.

    • Professional Considerations – Some individuals undergo evaluations to ensure that their substance use does not negatively affect job performance, licensing, or career advancement opportunities.

    • Proactive Measure Prior to Legal or Workplace Complications—Pursuing an assessment before substance use culminates in legal, academic, or employment repercussions is a constructive measure for averting future issues.

    • Harm Reduction or Treatment Exploration – Individuals who may not possess the desire to completely cease substance use, yet wish to utilize substances more safely, reduce their intake, or investigate treatment options, may find an evaluation beneficial.

    • Life Transitions or Significant Stressors – Periods characterized by stress, bereavement, or substantial life changes may lead to an increased propensity for substance use. An evaluation can assist individuals in discerning whether supplementary coping strategies are necessary.

  • A substance use evaluation, also known as a drug and alcohol evaluation or an addiction assessment, is a professional evaluation that determines how your current substance use impacts your life, relationships, and overall well-being. It may be required for probation, court, or other legal entities, such as diversion for sentencing. Substance Use Evaluations consider your history and provide treatment, education, and other support recommendations.

  • You may need an evaluation if it has been mandated by a judge, probation officer, attorney, or other legal entity due to a DUI, drug-related offense, probation requirement, or family court case. It helps determine whether treatment, education, or other interventions are necessary.

  • The evaluation typically includes:

    • A clinical interview to discuss your substance use history, mental health, and personal background.

    • Standardized Screening tools to assess substance use patterns.

    • A review of legal documents (if applicable)

    • A written report summarizing findings and clinical recommendations.

  • Most evaluations take 60-90 minutes, depending on the history and requirements of the case.

  • Since this is virtual, you will not drug test with me. However, courts require a 12-panel drug test to be included in the report, so you will have to schedule that test and provide me with the unaltered, sealed lab results so that I can include that in the assessment.

  • The evaluation does not determine legal outcomes, but it provides information that the court may consider when making decisions in your case. A fair, professional assessment can help demonstrate your commitment to compliance and self-improvement.
